GENERAL TERMS OF USE

CHIGIANA DIGITAL ONLINE SERVICE

1. SCOPE OF APPLICATION

1.1    The following General Conditions of Use (hereinafter “CONDITIONS”) govern all contracts concluded between the Accademia Chigiana Foundation (hereinafter “CHIGIANA”) with headquarters in Via di Città, 89 – 53100 SIENA (SI) Italy, represented by its Administrative Director Angelo Armiento and the CUSTOMER as defined in section 3.1 regarding the services offered on www.digital.chigiana.org.  

1.2   These CONDITIONS, the privacy policy, the registration according to Section 3 and the confirmation according to Section 5.3 constitute the entire agreement entered into between CHIGIANA and the CUSTOMER. The contractual languages are Italian and English.

2. ONLINE STREAMING SERVICES 

2.1.  On www.digital.chigiana.org CHIGIANA provides access to live concerts, video of pre-recorded concerts, on-site and online lecture recordings of courses, audio recordings, and other proprietary digital material,  for streaming over the Internet. Recordings of lectures, students ‘concerts and teachers’ concerts will be proposed in the archive. Access to live concerts is guaranteed via live streaming.

2.2.  CHIGIANA will decide independently which concerts, lessons and audio recordings are offered in streaming in video and audio formats. Furthermore, CHIGIANA reserves the right to remove certain contents from the archive for legal reasons and / or to exclude certain regions from the offer of streaming services for legal reasons (Geoblocking).

2.3. The provision of Internet access necessary for the use of the streaming services defined in sections 2.1 and 2.2 is not subject to the contract between the CUSTOMER and CHIGIANA.

3. REGISTRATION

3.1.  The CUSTOMER can use the streaming services offered by CHIGIANA only after registering as a user of CHIGIANA DIGITAL.

3.2.  Registration is done through the CUSTOMER’s Internet-enabled devices on www.digital.chigiana.org. To register, the customer must provide the following data: title, name, surname, email address, residential address, country, and (if required) a password.

3.3.  By sending the completed registration form, the CUSTOMER accepts this agreement relating to access to the CHIGIANA DIGITAL and its contents, and the use of streaming services (hereinafter “TERMS OF USE”).

3.4.  The CUSTOMER guarantees that all data entered during registration are correct and that it has not used third party data. The CUSTOMER will immediately inform CHIGIANA of any changes to the data.

4. USE 

4.1.  The use of streaming services is limited to the contents and times determined by CHIGIANA. The CUSTOMER can stream the contents offered on the website www.digital.chigiana.org only for personal and private use.

4.2.  The CUSTOMER must not abuse the streaming services. In particular, it is expressly forbidden to:

4.2.1. record digital content (video and audio of live streaming concerts, videos, masterclasses, lectures) in whole or in part;

4.2.2. use the streaming for commercial purposes or for public services;

4.2.3. transmit the contents publicly or distribute them in any other way;

4.2.4. play and broadcast the stream.

4.3.  If the CUSTOMER violates the terms defined in Section 4.2, CHIGIANA reserves the right to block the CUSTOMER’s access to the contents and to remove his ACCOUNT. 

4.4. Upon request, the CUSTOMER will receive an e-mail with a link to register. Once registered, the CUSTOMER will receive a second e-mail automatically generated by CHIGIANA to confirm the registration. This confirmation of receipt constitutes acceptance of these CONDITIONS OF USE of the services provided on the website www.digital.chigiana.org.

5. RIGHT OF WITHDRAWAL

5.1.  The CUSTOMER has the right to revoke his acceptance of the CONDITIONS OF USE at any time. Access to all CHIGIANA DIGITAL services will be interrupted. The information and data provided by the CUSTOMER are subject to the rules relating to the processing of sensitive data contained in the document at the Privacy Policy link. 

6.  USE OF STREAMING SERVICES, TECHNICAL REQUIREMENTS

6.1. Streaming services are offered for access to www.digital.chigiana.org.

6.2. For trouble-free reception, the CUSTOMER needs an Internet connection with a minimum bandwidth of 2 Mbps. However, a bandwidth of 5 Mbps or higher is recommended.

6.3. The CUSTOMER can access CHIGIANA DIGITAL streaming services on multiple devices. 

7.  USER ACCESS CREDENTIALS

7.1.  The access data (email address and password) can only be used by the CUSTOMER. The CUSTOMER cannot transfer the access data to third parties. The CUSTOMER will keep his access data secret and will modify or make CHIGIANA DIGITAL change the data if he becomes aware that his access data have been used improperly. This also applies in cases where improper use of login credentials is suspected.

7.2.  The CUSTOMER is responsible for all damages caused by third parties using his account, if and to the extent that he is to be held responsible. The CUSTOMER is responsible and must always prove that he is not guilty.

7.3.  If the CUSTOMER violates what is expressly reported in Section 7.1, CHIGIANA can block the CUSTOMER’s access. The CUSTOMER will be informed of this by e-mail.

8. WARRANTIES 

8.1.  CHIGIANA does not guarantee nor is responsible in any way for the correct functioning of the Internet connection or the performance of the final device used by the CUSTOMER.

8.2.  In the event of malfunctions or technical problems on the www.digital.chigiana.org server, CHIGIANA undertakes to solve the technical problems in the shortest possible time.

9. DATA PROTECTION

9.1  CHIGIANA collects and stores all the data necessary for the proper functioning of the website www.digital.chigiana.org and the streaming services connected to it. For the CUSTOMER’s personal data, CHIGIANA complies with the applicable legal provisions. For more information, refer to the privacy policy on the site.

10. COPYRIGHT AND AUTHOR’S RIGHTS

10.1  All texts, images, graphics and / or videos included or made available through www.digital.chigiana.org and their arrangement and graphic presentation on the website are subject to the Italian law on copyright and any further regulations of protection. The CUSTOMER may not use, distribute or modify any material made available on this website (for example text or graphics) without the prior explicit consent of CHIGIANA in writing and with signature certification required.

11. CHANGES TO THESE TERMS OF USE

11.1.  CHIGIANA reserves the right to modify the CONDITIONS OF USE at any time. The CUSTOMER will be informed of such changes in text form (in writing, no signature required, e.g. e-mail) at the latest 6 weeks before they take effect. 

12. COMPETENT COURT

12.1.  For all legal disputes, the FORUM OF SIENA is elected as the competent court.
